We limit our practice to cases in which serious harm has been done to our clients by people or corporations that have been negligent or committed an intentional wrong. Some of those claims include drivers of motor vehicles who are careless, companies who disregard safety standards, employers who wrongfully discharge employees, or who do not protect their employees from sexual harassment, and insurance companies who attempt to take advantage of injured persons by not complying with the fair trade practices laws.

If you would like to discuss your case with us, we do not charge for the initial consultation. Our staff will work with you to schedule an appointment for a mutually convenient time. Call (304) 485-4516.

Because of the large volume of questions, and our desire to provide good legal advice, we only provide legal advice to our clients (with whom we have a written agreement), and only after in-person consultation and discussion. Providing legal advice to a stranger over the Internet or over the telephone would be like a doctor making a diagnosis or prescribing medicine by e-mail or telephone; you would not want it.

Personal injury.

Personal injury law is a broad field of practice. As the name implies, it involves injuries (physical and emotional) to a person. Personal injury law runs the spectrum, from a simple car wreck, to a dangerous machine at work, to toxic chemicals in the air or water. There are many other types of actionable injuries for which the law provides a remedy.

Depending on the provable facts of a person’s case, the law provides for recovery of medical bills, payment of future medical bills, lost wages, wages that will be lost in the future, pain and suffering caused by the injuries, and, in appropriate cases, punitive damages

to punish the defendant for malicious conduct, and to deter other people and corporations from doing the same thing to others. ................................................................ [Back to top]

Insurance Company Misconduct
(bad faith).

Every insurance company is required to treat you fairly, including both your own insurer and the other driver's insurance company. That is because the insurance companies control the field of insurance, all the way from how the policy is written to how much of a premium they charge you, to how much to pay someone who is hurt by one of its policyholders. To even up the playing field a bit, the Legislature, the Supreme Court and the Insurance Commissioner have each set up laws and regulations to govern the activities of the insurance companies. But insurance companies occasionally wander away from those laws and regulations. The law provides ways to help the consumer.

For example, if you are hurt in a car wreck by someone else, their insurance company is required to promptly investigate the claim, and make you a fair settlement offer, when responsibility for the wreck is clearly on the other person. Even your insurance company has responsibilities to you, if you purchased Medical Payment, Uninsured Motorist or UnderInsured Motorist coverage. We have found that most people don’t have a clear understanding of their rights in this situation, until they talk to a lawyer knowledgeable and experienced in this field of law. ............................................................................ Employment Law.

This is one of the fastest growing areas of law. As companies merge, downsize, or look to cut costs, we are seeing an increasing number of workers wrongfully terminated, denied promotions, or wrongfully denied their benefits. The reasons vary from: racial, gender, age, or handicap to retaliation because the employee acted in accordance with the law or reported wrongful conduct by the employer. The law does provide relief (i.e., lost wages, attorney fees) for working people.
